Most attorneys at law will advise a seller not to sign a survey affidavit. In this way, the seller is not responsible for any encroachment or other survey issues. A survey affidavit shifts responsibility from the surveyor to the seller. Buyers should not rely on previous surveys either. Keep in mind that surveys are protected under federal copyright laws, so do not hand out unauthorized copies of this document.
